This page sets out the Terms and Conditions of Sale and Privacy Policy of TKM9 Group Pty Ltd, Play9 Studios Pty Ltd (ABN 60 629 938 763), and TKM9 Group US Inc (collectively "TKM9 Group", "we", "us", "our"). By engaging with us, placing an order, or using our websites and applications, you agree to the terms set out below.
PART 1 — TERMS AND CONDITIONS OF SALE
1. Quotations and Orders
1.1 All quotations are valid for 30 days from the date of issue unless otherwise stated.
1.2 Prices are subject to variation. Confirmed pricing is locked only upon receipt of a signed order confirmation or deposit payment.
1.3 TKM9 Group reserves the right to decline any order at its discretion.
2. Payment Terms
2.1 Product orders: 80% payment is required at time of order confirmation, with the remaining 20% due prior to dispatch (minimum 7 days advance notice).
2.2 Playspace installation projects: 50% deposit is required to commence design and production, 30% prior to production commencement, 15% prior to installation (minimum 7 days advance notice), and 5% upon final installation completion.
2.3 Payment terms may vary as agreed in writing by a company Director. Any variation will be noted in the applicable quotation or contract.
2.4 Invoices are payable in the currency specified on the quotation. Bank transfer and other payment methods accepted as agreed.
3. Delivery and Installation
3.1 Production and delivery timelines are estimates only. TKM9 Group will endeavour to meet agreed timelines but accepts no liability for delays caused by supply chain disruption, shipping, customs, or circumstances beyond our control.
3.2 The Client is responsible for ensuring the site is ready for installation by the agreed date. Delays caused by site readiness issues may result in additional charges.
3.3 Power, data, and conduit requirements are to be provided by the Client at the Client's cost unless otherwise agreed in writing.
3.4 Standard installation assumes standard business hours access and ground-level or lift access. After-hours work, high-security environments, or restricted access may incur additional charges.
4. Intellectual Property
4.1 All designs, artwork, software, game content, and technology created or supplied by TKM9 Group remain the sole intellectual property of TKM9 Group unless explicitly transferred in writing.
4.2 The Client is granted a licence to use supplied software and content for the purposes of operating the installed equipment only.
4.3 The Client must not copy, modify, reverse engineer, or redistribute any TKM9 Group software, content, or designs without prior written consent.
5. Warranties
5.1 TKM9 Group products are covered by a 12-month warranty against manufacturing defects from the date of installation or delivery, whichever is earlier, unless a separate warranty document specifies otherwise.
5.2 Warranty does not cover damage caused by misuse, neglect, unauthorised modification, or normal wear and tear.
5.3 Software and content subscriptions are provided on an ongoing basis subject to the applicable subscription agreement.
6. Limitation of Liability
6.1 To the maximum extent permitted by law, TKM9 Group's total liability to the Client for any claim arising out of or in connection with these Terms or any order shall not exceed the total value paid by the Client for the relevant order.
6.2 TKM9 Group is not liable for any indirect, consequential, or incidental loss including loss of revenue, loss of data, or loss of business opportunity.
7. Cancellation
7.1 Orders may not be cancelled once production has commenced without written agreement from a TKM9 Group Director.
7.2 Where cancellation is accepted, TKM9 Group reserves the right to retain deposit funds and recover costs incurred to date.
8. Governing Law
8.1 These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
8.2 For international orders, nothing in these Terms limits any rights available to the Client under applicable laws in their jurisdiction. Where required by local law, mandatory consumer protections apply in addition to these Terms.
8.3 For orders fulfilled through TKM9 Group US Inc or TKM9 Group UK entities, these Terms remain applicable subject to clause 8.2.
9. General
9.1 These Terms constitute the entire agreement between TKM9 Group and the Client with respect to the subject matter and supersede all prior representations, negotiations, and arrangements.
9.2 No variation of these Terms is effective unless agreed in writing and signed by a Director of TKM9 Group.
9.3 If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
PART 2 — PRIVACY POLICY
TKM9 Group is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and share personal information in connection with our websites, applications, products, and services.
1. Who We Are
TKM9 Group is a global interactive play space design and technology company headquartered in Melbourne, Australia, with registered entities in the United States and United Kingdom. Our websites are tkm9group.com and play9studios.com. We also operate Play9 Studios apps which may be available on the App Store and Google Play.
2. Information We Collect
We may collect the following types of personal information:
• Contact information: name, job title, organisation, email address, phone number
• Enquiry and project details submitted via contact forms or email
• Billing and payment information for orders (processed securely via third-party payment providers)
• App usage data if you use our Play9 Studios applications

4.1 Personal information is stored securely using reputable cloud-based platforms including Google Workspace. Access is restricted to authorised TKM9 Group personnel.
4.2 We retain personal information for as long as necessary to fulfil the purposes for which it was collected, or as required by law.
4.3 While we take reasonable steps to protect your information, no method of electronic storage or transmission is completely secure. We cannot guarantee absolute security.
5. Sharing Your Information
We may share personal information with:
• Service providers who assist us in operating our business (e.g. logistics, payment processing, IT support) under confidentiality obligations
• Our related entities (TKM9 Group Pty Ltd, Play9 Studios Pty Ltd, TKM9 Group US Inc) as required to fulfil your order or enquiry
• Legal or regulatory authorities where required by law
6. Cookies and Website Analytics
Our websites use cookies and analytics tools (including those provided by Wix and Google Analytics) to understand how visitors use our sites. This may include pages viewed, time spent, and general location data. This information is aggregated and does not identify you personally.
